1. Introduction

Welcome to SPARK Hosting. By using our services, you agree to comply with and be bound by the following terms and conditions.

2. Acceptable Use and Prohibited Activities

You agree to use our services only for lawful purposes. The following activities are strictly prohibited and will result in immediate termination of your account without a refund:

  • Hosting, distributing, or linking to illegal content, malware, or pirated materials.
  • Using our servers for cryptocurrency mining (e.g., Bitcoin, Ethereum, Monero, etc.).
  • Engaging in DDoS attacks, port scanning, or any malicious network activities.
  • Any other activities that violate local, national, or international laws.

3. Free Trial and Billing

New users are eligible to receive their first hour of hosting completely free of charge. After the free hour expires, standard billing rates apply. All payments are due upon receipt. If a payment is not received or payment method is declined, the buyer forfeits the ownership of any services purchased.

4. Uptime Guarantee

We strive to maintain a 99.9% uptime for all our hosting services. However, we are not responsible for any downtime caused by factors outside our control.

5. Data Persistence and Backups

Important: Our instances are ephemeral. All user data, including the Docker container and its contents, is permanently deleted immediately after an instance is stopped. Clients are ultimately responsible for backing up any critical data externally before stopping their instance. SPARK Hosting cannot be held liable for any data loss.

6. Data Privacy and GDPR Compliance

SPARK Hosting servers are located and hosted within the European Union (EU). We are committed to full compliance with the General Data Protection Regulation (GDPR). All user data is processed and stored in accordance with EU privacy regulations, ensuring the highest standards of data security and privacy protection.

7. Modifications to Terms

We reserve the right to modify these terms at any time. Your continued use of the service following any such modification constitutes your acceptance of the new terms.
